Submitting a notice
To report material you believe infringes your copyright, send the designated agent a written notice containing all of the following:
- A physical or electronic signature of the copyright owner or someone authorised to act for them.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material claimed to be infringing, with enough detail for us to locate it. For the Archive, please give the publication, issue number and page number.
- Your address, telephone number and email address.
- A statement that you have a good faith belief that the use is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate, and, under penalty of perjury, that you are the copyright owner or authorised to act for them.
An incomplete notice may not be effective.
Misrepresentation. Under 17 U.S.C. § 512(f), anyone who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and legal fees.
What happens next. We will remove or disable access to material we remove, and take reasonable steps to notify the affected user.
Counter-notification
If your material was removed and you believe it was a mistake or misidentification, you may send a counter-notification containing:
- Your physical or electronic signature.
- Identification of the material and where it appeared before removal.
- A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
- Your name, address and telephone number.
- A statement that you consent to the jurisdiction of the federal court for your district, or if you are outside the United States, for any district in which we may be found, and that you will accept service of process from the person who gave the original notice.
Repeat infringers
We terminate, in appropriate circumstances, the accounts of users who repeatedly infringe copyright.
